OVERVIEW


Dave Follett has over 25 years of experience working in the engineering and construction industry.  As a result of serving on the management teams of CANA Inc., a large commercial/industrial construction contractor, and AMEC Americas, a major international engineering and construction firm, Dave offers clients valuable insight into the structure and key drivers in the industry.  His background includes:

  • the management of major engineering and construction entities;
  • direct responsibility for development and adoption of contracting and risk management procedures and programs;
  • oversight, management and resolution of major claims and disputes; and
  • analysis and monitoring of ongoing projects during performance with a view to proactively identifying and addressing potential risks and issues.

Dave’s experience spans the industry and includes commercial construction, heavy industrial construction in various sectors, specialty subcontracting construction, and large project engineering and consulting engineering services. He has negotiated and participated in the management of engineering services agreements; engineering, procurement, and construction management retainers on multi-billion dollar programs; lump sum engineering, procurement, and construction agreements; multi-party alliancing relationships; and Public Private Partnership delivery models.

Throughout his career, Dave has focused his attention on the proactive identification and management of risk in the engineering and construction industry. He has combined his experience in the industry with a legal background, a detailed knowledge of insurance and surety and bonding issues affecting engineering and construction projects, and the key performance indicators for major capital projects to enable him to quickly identify and assimilate issues and to deliver comprehensive, clear, and concise advice to owners and contractors alike.

Dave has experience on projects located in North and South America, Europe, the Middle East, and South-East Asia.    

RECOGNITION

  • Construction Risk and Insurance Specialist, International Risk Management Institute

REPRESENTATIVE EXPERIENCE

  • Reviewed and assisted with a multi-party Alliance Agreement and directed coordination between this and internal LLC alignment, Operating Agreement and project insurance program.
  • Developed and directed the structuring, documenting, and risk allocation strategy for a proposal for the financing, engineering, construction, and operation of a $1.2 Billion rapid transit project being bid on a Public Private Partnership basis.
  • Participated in satisfactory conclusion of a performance warranty dispute on a major offshore gas facility performed through an Alliance among several contractors and multiple ownership interests.
  • Arranged contracts, joint venture agreements, and insurance and bonding programs for the engineering, procurement, and construction of a $180 million industrial facility.
  • Assisted with structuring, negotiating and documenting the financing, engineering, construction, and operation of toll highway projects on a Public Private Partnership basis.
  • Managed the structuring of a multi-party joint venture, negotiation of EPC contract terms, and insurance and bonding issues for EPC performance of a $600 million oil and gas project. 
  • Participated in the successful resolution of multi-party claims arising from a fire in a facility under construction that resulted in loss of life, significant property damage, and project disruption.
  • Negotiated contracts for EPC development of gas compression facilities in South America.
  • Negotiated an engineering services agreement with a Russian client for an oil field development in the Middle East.
  • Acted as Company representative on the Joint Venture Committee for a three party design-build rapid transit project and assisted with resolution of subsequent disputes among the partners and between the Joint Venture and the client.
